COMBINED NOTICE AND ORDER OF HEARING



BY ORDER OF THE DISTRICT COURT IN AND FOR THE COUNTY OF CHEROKEE, OKLAHOMA: NOTICE IS HEREBY GIVEN that Marnie Cope has been appointed personal representative (executrix) of the estate of Kay Lynn Burns. The Court will hold a hearing on the 2nd day of January, 2018, at 10:30 A.M., in Judge Dobbins’ Courtroom of the Cherokee County Courthouse at which time the Court will consider the following:



I. Admission of the Will to Probate

II. Petition for Summary Administration

III. The Final Accounting

IV. Petition for Determination of Heirship, Distribution and Discharge



The following information is provided to interested parties:

1. Decedent Kay Lynn Burns, born March 28, 1952 in McAllen Texas, departed this life September 20, 2017 in Muskogee County Oklahoma. Her address at the time of death was in Cherokee County at 1350 North Jones Avenue #102, Tahlequah, OK 74464. Oklahoma at death.

2. Petitioner Marni Cope of 16937 West Clyde Maher Road, Tahlequah, OK 74464, produced the original Last Will and Testament of the decedent, filed herein, wherein a person was nominated as Personal Representative who lives away and who declined to serve.

3. The stated heirs, devisees and legatees are all adults: Barbara Phillips (predeceased) whose bequest lapsed; Charles Carrico of Broken Arrow, OK; Dee O’Bryan of Proctor, OK; Marnie Cope of Tahlequah, OK; Sandra Crittenden of Tulsa, OK; James M. Borren of Sand Springs, OK; Laura Branson Montgomery of Rogers, AR; Emmitt Roberts of Decatur, TX, Sue Neely Address Unknown; Cliff & Tosca Harris of Chanute KS; Michelle Norman of Tahlequah, OK; Pamela Backward of Tulsa OK; Scott Harbison of Vernal UT; Mark Harbison of Kihei, HI; Rebecca Swisher of Mustang, OK; and the following corporate legatees: DVIS Tulsa, Tulsa OK; Tulsa County Library of Tulsa OK; Tulsa SPCA of Tulsa, OK.

4. The probable value of the estate of the decedent as set forth in the petition is about $42,500.00

5. The Summary Hearing will be held January 2, 2018 at the hour of 10:30 a.m. Interested persons may file objections to the petition at any time before the final hearing and send a copy to the petitioner or that person will be forever barred. The Court will decide whether the Will attached to the petition shall be admitted to probate, whether summary proceedings are appropriate and, if so, whether the estate will be distributed and to whom the estate will be distributed. Creditors having claims against the estate must present their claims, with a description of all security interests and other collateral (if any) held by each creditor with respect to such claim, to Marnie Cope, 16937 West Clyde Maher Road, Tahlequah OK 74464 or Attorney Kathy Tibbits at 35966 South Cherokee Drive, Park Hill OK 74451 within 30 days of this notice, or the claim will be forever barred.
